Medsker breach of contract case dismissed

HARRISONVILLE – A nearly half-million dollar breach of contract case against Cass County Recorder of Deeds Mike Medsker, who is running unopposed in the August Republican primary for re-election to his seat, was dismissed without prejudice Tuesday in Cass County Circuit Court.

A dismissal without prejudice means the case could be refiled in the future.
The case was filed in connection with a promissory note taken by Medsker from Country Club Bank in early 2025, due in full last summer. No payments had been made on the loan, which was secured by his home at 1106 Creekside Court in Raymore, at the time the suit was filed this spring.
In his motion for a recent extension of time to file a response, Medsker’s attorney, Colin Nacy Gotham of Kansas City, wrote that “the parties are attempting to resolve, and the Defendants are still reviewing the allegations and conducting an investigation into the allegations in order to prepare their answer or other response.”
The Creekside Creek home was set to be sold by sheriff’s auction on June 5. Medsker said in an email last week, “I sold to an individual well before auction.”
County records, however, show Medsker and his wife, Angela, sold to Daytona Capital, LLC, an investment firm located in Lee’s Summit, on June 1 – four days prior to the scheduled auction. Three weeks later, on June 23, Daytona Capital sold the property to MGRU Properties, LLC, of Kansas City. SPR Analytics defines MGRU as a “real estate flipper” firm with investments across the metro area.
Medsker says said he now lives elsewhere in Raymore, which satisfies residency requirements for his re-election bid.
He is running unopposed in next month’s primary, but faces Democrat challenger Art Ruiz in the November general election.
Medsker, a Republican first elected as Recorder of Deeds in 2010, also operates a Farmers’ Insurance agency in Raymore. That agency was listed as a joint defendant in the breach of contract and breach of guaranty action.
In the suit, the bank listed a $386,907.78 business loan issued on Jan. 27, 2025, and personally guaranteed by Medsker, with a maturity and due-in-full date of July 27, 2025.
According to the suit, that payment was not made, and the total amount due as of May 5 of this year is $432,117.70. Interest continues to accrue on the balance to the tune of $112.85 per day, according to the suit.
The Recorder of Deeds office is the repository for all Cass County land transactions. The Recorder’s duties include reviewing, processing, recording and delivering back to the submitter all transfers of property and related documents in a timely manner.
